Collingridge’s dilemma is one of the most well-established paradigms presenting a challenge to Technology Assessment (TA). This paper aims to reconstruct the dilemma from an analytic perspective and explicates three assumptions underlying the dilemma: the temporal, knowledge and power/actor assumptions. In the light of the recent transformation of the science, technology and innovation system—in the age of technoscience —these underlying assumptions are called into question. The same result is obtained from a normative angle by Collingridge himself; he criticises the dilemma (...) and advances concepts on how to keep a technology controllable. This paper stresses the relevance of the dilemma and of Collingridge’s own ideas on how to deal with the dilemma. Today, a positive interpretation of technoscience for effective TA is possible. This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher than (...) without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. The objective of this paper is to contribute to the expanding discourse on conceptual elements of TA. As a point of departure, it takes the recent transformation of the science, technology and innovation system ( technoscience ). We will show that the age of technoscience can be regarded as presenting not only a challenge, but also a chance and opportunity for TA. Embracing this opportunity, however, implies imposing several requirements on TA. In order to specify these requirements and to foster (...) the ongoing discourse on the foundations of TA, this paper suggests a programmatic term: prospective technology assessment (ProTA). This term is intended mainly as a reflection framework, aimed at providing an extension and complement—and not a replacement—of well-established TA concepts. Three requirements for ProTA are sketched: (1) early stage orientation—the temporal dimension, (2) intention and potential orientation—the knowledge dimension, (3) shaping orientation—the power/actor dimension. Examples from fusion and nano research will illustrate the need for ProTA, as well as its specific focus. The paper concedes that ProTA is in its infancy and that there is a clear need for further clarification. (shrink)

I argue that there is an important problem with framing the value of a liberal arts education through a contrast between intrinsic and instrumental value. The paper breaks down into three sections. First, I argue that the traditional divide between intrinsic and instrumental value conflates two pairs of related concepts and that distinguishing those concepts frees us from an important impasse found in contemporary discussions about the liberal arts. Second, I argue that a liberal arts education is only intelligible as (...) a practice if we value it for its own sake. Third, I explain how we can value a liberal arts education as an end even if we reject the possibility of intrinsic value. I conclude with a brief statement of the practical implications my account has for the way we approach the liberal arts. (shrink)

Recent discussions about the cognitive value of fiction either rely on a background theory of reference or a theory of imaginative pretense. I argue that this reliance produces a tension between the two central or defining claims of literary cognitivism that: (1) fiction can have cognitive value by revealing or supporting insights into the world that properly count as true, and (2) that the cognitive value of a work of fiction contributes directly to that work’s literary value. I address that (...) tension by looking at the formal devices present in a work of fiction that enable it to realize the fictional world described by a text. When we focus on those formal elements, we can identify a connection between a work of literary fiction and the insights we gain through an encounter with the fictional world that work realizes. One common set of arguments against universal markets contends that the special status of certain goods (e.g., organs, reproductive services, or native artifacts) makes it inappropriate or wrong to compare their worth to the value of a commodity or to some amount of money. These arguments rest on the fear that market valuations would distort the way we value the goods in question rather than the fear that their sale could exploit or directly harm the people involved in the exchange. In this paper I use behavioral economics to explain why these arguments persuade so many people despite the fact that we already engage in a wide range of economic valuations with respect to those contested domains. I conclude by identifying the implications this has for the broader debate over contested markets. (shrink)

The fate of root epidermal cells is controlled by a complex interplay of transcriptional regulators, generating a genetically determined, position‐biased arrangement of root hair cells. This pattern is altered during postembryonic development and in response to environmental signals to confer developmental plasticity that acclimates the plant to the prevailing conditions. Based on the hypothesis that events downstream of this initial mechanism can modulate the pattern installed during embryogenesis, we have developed a reaction diffusion model that reproduces the root hair patterning (...) previously observed experimentally. Under all growth conditions, an almost equal spacing between root hair forming cells was observed both in vitro and in silico, indicating that long‐range intercellular communication is crucial for the trichoblasts' decision to form a root hair. We assume that a hair growth promoter (HGP) is upregulated in root‐hair‐forming cells by a trichoblast‐specific component. Once established, HGP production is self‐enhancing. The autocatalytic regulation of HGP is antagonized by an HGP‐produced hair growth inhibitor (HGI). HGI is exported from trichoblasts and diffuses to neighboring cells, where it inhibits further HGP production and promotes the non‐hair cell fate. Under conditions of phosphate deficiency, we hypothesise that HGP production is increased and HGI diffusion rate is reduced, leading to a position‐independent formation of extra root hairs. I Die vermeintliche „Überwindung“ der politischen Theologie Die Geschichte der politischen Theologie in der Moderne erweist sich vorläufig immer noch als die Geschichte ihrer misslungenen Überwindungen. Trotz ihrer vielfachen Erledigungen zeigt die politische Theologie, entgegen Hans Blumenbergs Prognose, eine erstaunliche Fähigkeit zur „Selbstbehauptung“. Ihre Resistenz verdankt sie dabei nicht zum Geringsten der Prätention all derjenigen Gegner, die meinten, man könne, indem man eine spezifische Form von politischer Theologie kritisiert, gleich mit allen Spielarten des politisch-theologischen Diskurses aufräumen. Ohnehin werden die meisten (...) Überwindungen der politischen Theologie im Namen einer anderen politischen Theologie vorgenommen. So die berühmteste, von Erik Peterson stammende Widerlegung, die als Fazit der Untersuchung zum „Monotheismus als politisches Problem“ gegen Carl Schmitts politische Theologie gewendet war und den eher anstößigen Sprachgebrauch von der „Erledigung“ in Umlauf gebracht hat. Sie wurde von Peterson jedenfalls im Namen der trinitarischen Theologie des Augustinus vorgenommen, wobei Peterson eine solche Erledigung schon im Rahmen einer an Paulus' Römerbrief orientierten Theopolitik erprobt hatte. Darüber hinaus muss der Begriff der politischen Theologie nicht notwendig gegen die „Legitimität der Moderne“ eingesetzt sein, sondern versteht sich oft genug als deren dialektische Kritik, wie etwa bei Martin Buber, Paul Tillich oder später bei Jürgen Moltmann und Johann Baptist Metz. In everyday life we often act adequately, yet without deliberation. For instance, we immediately obtain and maintain an appropriate distance from others in an elevator. The notion of normativity implied here is a very basic one, namely distinguishing adequate from inadequate, correct from incorrect, or better from worse in the context of a particular situation. In the first part of this paper I investigate such ‘situated normativity’ by focusing on unreflective expert action. More particularly, I use Wittgenstein’s examples of craftsmen (...) (tailors and architects) absorbed in action to introduce situated normativity. Situated normativity can be understood as the normative aspect of embodied cognition in unreflective skillful action. I develop Wittgenstein’s insight that a peculiar type of affective behaviour, ‘directed discontent’, is essential for getting things right without reflection. Directed discontent is a reaction of appreciation in action and is introduced as a paradigmatic expression of situated normativity. In the second part I discuss Wittgenstein’s ideas on the normativity of what he calls ‘blind’ rule-following and the ‘bedrock’ of immediate action. What matters for understanding the normativity of (even ‘blind’) rule-following, is not that one has the capacity for linguistic articulation or reflection but that one is reliably participating in a communal custom. In the third part I further investigate the complex relationships between unreflective skillful action, perception, emotion, and normativity. Part of this entails an account of the link between normativity at the level of the expert’s socio-cultural practice and the individual’s situated and lived normativity. (shrink)

Rational agents are supposed to maximize expected utility. But what are the options from which they choose? I outline some constraints on an adequate representation of an agent’s options. The options should, for example, contain no information of which the agent is unsure. But they should be sufficiently rich to distinguish all available acts from one another. These demands often come into conflict, so that there seems to be no adequate representation of the options at all. After reviewing existing proposals (...) for how to construe decision-theoretic options and finding them all wanting, I suggest that our model of rational agents should include a special domain of ‘virtual’ option propositions to serve as formal objects of deliberation and choice. What should we believe when epistemic and practical reasons pull in opposite directions? The traditional view states that there is something that we ought epistemically to believe and something that we ought practically to (cause ourselves to) believe, period. More recent accounts challenge this view, either by arguing that there is something that we ought simpliciter to believe, all epistemic and practical reasons considered (the weighing view), or by denying the normativity of epistemic reasons altogether (epistemic anti-normativism). I argue against (...) both accounts and defend the traditional view. An agent can be blameworthy in doxastic dilemmas for complying with their practical but not their epistemic reasons. This reveals how epistemic reasons are normative: the concept of epistemic blame helps us track epistemic normativity. (shrink)

In this paper, we put forward two novel arguments against the counterfactual comparative account (CCA) of harm and benefit. In both arguments, the central theme is that CCA conflicts with plausible judgements about benefit and prudence.

The normative force of evidence can seem puzzling. It seems that having conclusive evidence for a proposition does not, by itself, make it true that one ought to believe the proposition. But spelling out the condition that evidence must meet in order to provide us with genuine normative reasons for belief seems to lead us into a dilemma: the condition either fails to explain the normative significance of epistemic reasons or it renders the content of epistemic norms practical. The first (...) aim of this paper is to spell out this challenge for the normativity of evidence. I argue that the challenge rests on a plausible assumption about the conceptual connection between normative reasons and blameworthiness. The second aim of the paper is to show how we can meet the challenge by spelling out a concept of epistemic blameworthiness. Drawing on recent accounts of doxastic responsibility and epistemic blame, I suggest that the normativity of evidence is revealed in our practice of suspending epistemic trust in response to impaired epistemic relationships. Recognizing suspension of trust as a form of epistemic blame allows us to make sense of a purely epistemic kind of normativity the existence of which has recently been called into doubt by certain versions of pragmatism and instrumentalism. Logical pluralism is the view that there is more than one correct logic. Most logical pluralists think that logic is normative in the sense that you make a mistake if you accept the premisses of a valid argument but reject its conclusion. Some authors have argued that this combination is self-undermining: Suppose that L1 and L2 are correct logics that coincide except for the argument from Γ to φ, which is valid in L1 but invalid in L2. If you accept (...) all sentences in Γ, then, by normativity, you make a mistake if you reject φ. In order to avoid mistakes, you should accept φ or suspend judgment about φ. Both options are problematic for pluralism. Can pluralists avoid this worry by rejecting the normativity of logic? I argue that they cannot. All else being equal, the argument goes through even if logic is not normative. (shrink)
